GENERAL TERMS AND CONDITIONS

1. These are applicable to all services provided by Tony Day, the Parenting Skills Coach and any of his associates to any individual or organisation, hereafter referred to as “the client”.

2. In return for the fees payable by the client (or by a third party acting on their behalf), the Parenting Skills Coach agrees to provide the services described below in accordance with the relevant terms and conditions set out below.

3. The client agrees to pay fees for the service on the terms and conditions set out below (in situations where a third party pays the fees, the third party counts as an agent acting on behalf of the client).

Confidentiality

4. All personal information supplied by clients, whether spoken or written, will be treated as confidential. It will not be disclosed to a third party without the client’s prior permission, except where required by law or where action might be necessary to prevent harm to the client or someone else (e.g. in relation to child welfare).

Privacy Policy

5. The Parenting Skills Coach is committed to protecting your privacy. The information collected about clients and their families is done lawfully (in accordance with the Data Protection Act 1998). All information is kept confidential and not disclosed, shared or sold to any third party (subject to the caveat outlined in paragraph 4).

6. The information held by the Parenting Skills Coach will be accurate and up to date. You can check the information that we hold about you by emailing us. If you found any inaccuracies, we would promptly delete or correct the relevant information. The personal information which we hold, whether in printed or electronic form, is held securely in accordance with good practice procedures and so protected from loss or theft.

7. The Parenting Skills Coach gathers various information about clients and their circumstances, including:

  • Personal details and contact information of parents-carers
  • Names and ages of children
  • Details of any parenting issues and objectives expressed by parents-carers
  • Details of any special needs of parents-carers or their children
  • Records of attendance at parenting course sessions and coaching sessions
  • Records of clients’ payments made or due to the Parenting Skills Coach
  •  Notes of coaching sessions, including outline details of topics discussed and actions which clients and/or the Parenting Skills Coach have agreed to take
  • Copies of clients’ written evaluations of parenting courses and coaching sessions
    (Anonymous extracts from these – in the form of “testimonials” – may be used on the Parenting Skills Coach’s website and other marketing materials to illustrate the benefits of the Parenting Skills Coach’s services, unless clients expressly state that they do not wish this done in respect of any comments they make about the Parenting Skills Coach’s services.)
  • Relevant financial details of clients, sufficient to arrange clients’ payments for services they have received

8. In addition to the above, the Parenting Skills Coach also collects and processes some statistical information. This includes the following. However, none of this information is linked to, or identifies, individual clients:

  • Statistical Information about “traffic” using the Parenting Skills Coach website. Software such as Google Analytics is used to evaluate levels and patterns of website usage to help evaluate the website’s usefulness to users
  • Overall analysis and evaluation of Parenting Skills Coach services, including the number of parents-carers attending parenting courses and their views of the courses they have attended. Such information will be used to publicise and market the services offered by the Parenting Skills Coach, but will not refer to individual clients or their families, either specifically, or by implication, in such a way that individuals could be identified. From time to time, copies of these analyses and evaluations will be published on the Parenting Skills Coach website and can be made available to clients to see if they wish

Insurance

9. The activities of the Parenting Skills Coach are covered by appropriate Professional Indemnity insurance and by Public Liability insurance and the course venues used by the Parenting Skills Coach are also covered by appropriate insurance. However, the Parenting Skills Coach does not insure clients’ personal belongings and clients are therefore responsible for making appropriate provision in respect of insurance arrangements to protect their property while attending courses or coaching sessions provided by the Parenting Skills Coach.

Respective responsibilities of the Parenting Skills Coach and Clients

10. The Parenting Skills Coach is responsible for:

  • Always working with clients in accordance with the Parenting Skills Coach’s stated values, which are: Customer First; Belief in Human Potential; Professionalism; Ethical Behaviour; Innovation, Learning and Drive; and Demonstrating Value (more details about these values is given on the About page)
  • Providing the agreed services (e.g. parenting course sessions or coaching sessions) to the highest standard, in accordance with agreed dates and times and in accordance with accepted good practice
  • Treating all clients respectfully and as individuals, while ensuring that all clients or potential clients are treated equally irrespective of their gender, marital status, age, socio-economic status, race, ethnic or national origin, political or religious conviction, sexual orientation or any disability
  • Seeking to make reasonable adjustments in respect of any special needs individual clients may have and which the Parenting Skills Coach has been notified of (e.g. arranging course venues which are accessible for wheelchair users)

11. The client is responsible for:

  • Being committed to the changes they wish to achieve. As the saying goes, “If you keep on doing what you’ve always done, you’ll keep on getting what you’ve always got”!
  • The decisions and actions they take (or choose not to take) on the basis of the information offered to them by the Parenting Skills Coach. Remarkable results can be achieved when clients apply relevant, “good practice” approaches to parenting in a thoughtful, consistent, persistent and committed way. However, because these results ultimately depend on what clients, their partners and others do or choose not to do, clients must inevitably retain responsibility for the outcomes achieved from their participation in parenting courses and parenting coaching sessions
  • Attending and participating in courses and/or coaching sessions (as appropriate) in accordance with the relevant course group agreement (or “ground rules” discussed and agreed by course members) or relevant coaching agreement (e.g. not sharing with others outside of parenting groups sensitive or personal information shared by other attendees of the group). If a client failed to abide by the relevant course group agreement or otherwise was deemed by the Parenting Skills Coach to have acted inappropriately, the client would be liable, at the sole discretion of the Parenting Skills Coach, to be asked to leave the course immediately. In this case, the client would be reimbursed for the price of complete outstanding course sessions (i.e. not for those sessions already attended).
  • Paying promptly for agreed services, in accordance with published prices and payment arrangements shown on the Parenting Skills Coach website
  • Advising the Parenting Skills Coach of any special needs they may have which may impact on their ability to access or benefit from services offered by the Parenting Skills Coach
  • Respecting the copyright and intellectual property rights of all materials made available to them by the Parenting Skills Coach

Disclaimers

12. Whilst every care is taken in the preparation of services and the materials and information provided as part of those services, the Parenting Skills Coach does not warrant that the information provided is in every respect accurate or complete and, therefore, the Parenting Skills Coach is not responsible for any errors or omissions or for the results obtained from the use of such information. Clients are therefore encouraged to confirm any such information or advice received with other qualified sources (e.g. medical or other suitably qualified professional personnel).

13. The coaching information and services provided by the Parenting Skills Coach are designed to help clients achieve their parenting objectives. They are not intended to provide and should not be regarded as providing any form of counselling or therapy. If, for any reason, a client believes they may have a psychological or medical condition, they are strongly advised to consult a suitably qualified clinician.

14. Also, please note that although the Parenting Skills Coach uses reputable virus checking software, it cannot be guaranteed that documents emailed by the Parenting Skills Coach to clients or available to clients to download from the Parenting Skills Coach website will always be free from computer viruses, spyware or other malicious software. Therefore, the Parenting Skills Coach does not warrant that to be the case and strongly recommends clients to ensure they have up to date, reputable virus checking software running on their own computers or other electronic devices and always use it check all emails and all downloads for viruses before opening them or saving them on their computer of other electronic device.

Variation of Terms and Conditions

15. The Parenting Skills Coach reserves the right to vary any of the terms and conditions in this document (and the prices for Parenting Skills Coach services which are published on the Parenting Skills Coach website) if circumstances should make that necessary. Any new terms and conditions and new prices for services will be published on the Parenting Skills Coach website and notified to relevant clients.

16. However, in the event of price rises, the price agreed with existing clients would be honoured for the all of the course or coaching sessions which the client has already paid for or signed an agreement to receive from the Parenting Skills Coach. Any higher prices would only apply to new clients or to additional coaching sessions or courses which existing clients ask to receive after notification/publication of any higher prices.

TERMS AND CONDITIONS IN RELATION TO PARENTING COURSES

17. These terms and conditions apply to “The Incredible Years” course, “The Parent Factor in ADHD” course and all other parenting courses delivered to groups of parents by the Parenting Skills Coach.

Course applications

18. Applications can be made on-line, using the relevant application form on the Parenting Skills Coach website (www.theparentingskillscoach.com). Alternatively, an application form can be downloaded from the website by the applicant and then completed and returned to the Parenting Skills Coach, either by email or by post. For clients without access to the Internet, printed application forms can be obtained from the Parenting Skills Coach.

19. As soon as possible after the receipt of the application, applicants will be contacted to arrange a home visit by the Parenting Skills Coach to enable a detailed discussion about the course and its usefulness to the applicant’s circumstances and objectives. If it is not feasible for a face to face visit to be arranged, a phone conversation will be arranged in its place for a time convenient for the applicant.

Payment for courses

20. Assuming, following the above meeting or phone conversation, the applicant confirms their wish to attend the relevant course, they will be allocated a place and the full course fee will become due for payment to the Parenting Skills Coach. Full payment of course fees must be received by the Parenting Skills Coach before the start of the relevant course.

21. Payment can be made either by cheque, or preferably, by direct bank transfer (BACS). Cheques should be made payable to “T.Day” please. Bank credit transfers should be made using the following account details please:

22. Receipts will be provided for all monies paid to the Parenting Skills Coach except where payment is made through BACS or standing order

Cancellation or postponement of sessions or courses

23. If, for any reason (e.g. illness of course facilitators or because a venue becomes unexpectedly unusable or unavailable), it is necessary for a session to be postponed or cancelled, the Parenting Skills Coach will – in consultation with course attendees – arrange for the relevant session(s) to be rescheduled at a later date or to increase the length of subsequent sessions to enable inclusion of the material from the postponed session(s).

24. The Parenting Skills Coach reserves the right to cancel or reschedule a complete course at its discretion if, in the opinion of the Parenting Skills Coach, there are insufficient applicants when the course is due to commence. If this were necessary, all applicants would be informed before the planned course start date and those parents who had applied to do the cancelled course would automatically be offered a place on a later course. If this was not acceptable to any applicant, the Parenting Skills Coach would pay the applicant a full refund of any course fees already paid to the Parenting Skills Coach.

25. In the unlikely event that it were necessary to cancel a part-completed course, the Parenting Skills Coach would reimburse each attendee an amount of the course fee proportionate to the number of sessions which were outstanding when the course had to be cancelled. For example, if a ten-session course costing £150 was cancelled after five sessions (i.e. with five sessions remaining), each attendee would be reimbursed £75 (i.e. 5/10 or half of the £150 course fee).

Client not attending sessions or withdrawing from a course

26. The Parenting Skills Coach will not be liable to reimburse clients for any parenting course session they choose not to attend or are unable to attend. However, the Parenting Skills Coach will make available to any clients who miss sessions copies of the materials used in the relevant sessions and will also verbally summarise for relevant clients the main points covered in the session(s) the client has missed.

27. Similarly, the Parenting Skills Coach will not, as a matter of course, be liable to refund any course fees should a client decide to withdraw from the course. Only in genuinely exceptional cases (e.g. serious illness) would a proportional reimbursement of course fees be considered (e.g. half the course fee if half of the scheduled course sessions are outstanding when a client decides to withdraw from a course).

Course certificates

28. The Parenting Skills Coach will award course certificates to each parent-carer who attends at least 70% of sessions (i.e. at least seven sessions for a 10 week course and at least nine sessions for a 12 week course).

Late joiners

29. If there are still places available on a course, it will be possible to join a course up to and including the third session of a course. In such cases, the Parenting Skills Coach will provide the late joiner with access to the materials and information covered in the missed sessions and the late joiner will only need to pay a proportionate amount of the total course fee for all of the remaining sessions of the course.

Attendance of children

30. Unless specific arrangements have been made by the Parenting Skills Coach for an onsite crèche to run alongside a course, parents are requested not to bring their children with them to courses. The only exception to this arrangement may be for parents to bring young babies with them to groups, provided other group members are happy for this to happen.

Session start and finish times

31. Because there is a lot of information to cover in courses, all sessions will start and finish on time, even if some attendees are late. If, for unavoidable reasons, the start of a session is delayed, the session will be extended – if this is acceptable to attendees – or the relevant amount of time will be added to a subsequent session.

Start of course and end of course questionnaires

32. Before the start of parenting courses each parent-carer will be invited to complete a questionnaire about their parenting experience. The questionnaire is known as the TOPSE questionnaire, which stands for “Tool to measure Parenting Self-Efficacy”. The questionnaire was developed by staff at the University of Hertfordshire and a copy is available to view here.

33. Completion of the TOPSE questionnaire is completely optional, but parents are encouraged to complete it as it can be valuable in several important ways. Firstly, it can help parents reflect on their parenting, including what they are happy with and what they would like to see change. As a result, this can highlight which parenting topics or issues parents would like to particularly focus on in the course. Finally, as parents are also invited to complete the TOPSE questionnaire at the end of the course, the questionnaire can be used to highlight any changes which have occurred during the course.

34. Alongside the TOPSE questionnaire, parents will be asked to complete a course evaluation questionnaire at the end of each course, which will provide an opportunity for them to evaluate different parts of the course content and overall arrangements for the course.

35. All completed questionnaires will be treated confidentially by the Parenting Skills Coach and individual questionnaires will not be shared with any third party, without the specific approval of the parent concerned. Collective evaluations and analyses of questionnaires will be published in reports and in marketing materials but not in such a way that any individual parents of their children will be identifiable.

TERMS AND CONDITIONS IN RELATION TO COACHING

36. In addition to parenting courses, the Parenting Skills Coach offers a range of coaching options, which some parents-carers may prefer. These are as follows. In all cases, the number of coaching sessions and the issues to be considered during the coaching sessions are discussed and agreed at the start of the coaching programme, providing parents with the opportunity to have a coaching programme designed to meet their specific circumstances and objectives.

COACHING OPTIONKEY FEATURES
1:1 COACHING:

The Parenting Skills Coach works with one parent

VENUE: The parent’s home or other agreed venue. If a venue has to be hired this can be arranged by the Parenting Skills Coach, but the cost would be payable by the client (typically £10-£20 per hour)

NUMBER OF SESSIONS: Minimum of five, hour-long sessions. The first session (of up to an hour) is free and is used to: discuss and agree the topics on which the parent wants the coaching to focus and to agree the dates and times of subsequent coaching sessions (a minimum of four)

PRICE: £35 per hour.
Please note that the Parenting Skills Coach’s travelling time to and from the coaching venue is chargeable at the same rate and that mileage is chargeable at 40p per mile.

FAMILY COACHING:

The Parenting Skills Coach works with both parents, children and other family members as required

VENUE: The family’s home or other agreed venue. If a venue has to be hired this can be arranged by the Parenting Skills Coach, but the cost would be payable by the client (typically £10-£20 per hour)

NUMBER OF SESSIONS: Minimum of five, hour-long sessions. The first session (of up to an hour) is free and is used to: discuss and agree the topics on which the family wants the coaching to focus and to agree the dates and times of subsequent coaching sessions (a minimum of four)

PRICE: £35 per hour.
Please note that the Parenting Skills Coach’s travelling time to and from the coaching venue is chargeable at the same rate and that mileage is chargeable at 40p per mile.

GROUP COACHING:

The Parenting Skills Coach works with a group of up to 10 parents (perhaps friends)

VENUE: Any venue agreed as suitable by the Parenting Skills Coach. If a venue has to be hired this can be arranged by the Parenting Skills Coach, but the cost would be payable by the client group (typically £10-£20 per hour)

NUMBER OF SESSIONS: Minimum of five, two-hour sessions. The first session (of up to two hours) is free and is used to: discuss and agree the topics on which group members want the coaching to focus and to agree the dates and times of subsequent coaching sessions (a minimum of four)

PRICE: £50 an hour for the whole group
Please note that the Parenting Skills Coach’s travelling time to and from the coaching venue is chargeable at the same rate and that mileage is chargeable at 40p per mile.

TELEPHONE AND ON-LINE COACHING:

This is usually best suited to 1:1 coaching or to working with two parents

VENUE: Not applicable

NUMBER OF SESSIONS: Minimum of five, hour-long sessions. The first session (of up to an hour) is free and is used to: discuss and agree the topics on which the family wants the coaching to focus and to agree the dates and times of subsequent coaching sessions (a minimum of four)

PRICE: £35 per hour.
Travelling time and mileage charges are clearly not applicable to this option. However, please note that the client is required to make the call to the Parenting Skills Coach at the agreed times. Calls can be made via Skype – which is often free – or via mobile or land line phone. Contact numbers are on the Parenting Skills Coach website

Coaching agreement

37. To record the agreement reached in the initial free coaching session between the Parenting Skills Coach and the client(s) as regards the number, dates, times and subjects of coaching sessions, the Parenting Skills Coach will draw up a coaching Agreement which will be signed by the Parenting Skills Coach and by the client(s).

Payment

38. Full payment for all agreed coaching sessions must either be received by the Parenting Skills Coach prior to the first payable coaching session, or the client must agree arrangements with the Parenting Skills Coach for payments to be staged (e.g. via direct debit or standing order). Payment arrangements are described in paragraphs 20 to 22.

39. If cleared payment has not been received by the Parenting Skills Coach in advance of a coaching session, the Parenting Skills Coach is not obliged to provide that session or any subsequent sessions.

Additional Sessions

40. If the Parenting Skills Coach and client agree that additional coaching sessions would be beneficial after completion of the initial agreed sessions, the same terms and conditions, including price, will apply to any additional sessions and the original coaching agreement will be updated appropriately.

Cancellation or postponement of coaching sessions

41. If a client needs to rearrange a coaching session, they should provide at least 48 hours notice. In which case a new date and time, mutually convenient to the client and to the Parenting Skills Coach, would be agreed as soon as possible. No refunds will be given to clients for unused coaching sessions unless 48 hours notice has been given. In other words, the missed session would be forfeited and an additional session fee would be payable for an extra session to replace the missed session.

42. In exceptional circumstances, the Parenting Skills Coach may need to rearrange a coaching session. In those instances, the Parenting Skills Coach would also be required to give the client 48 hours notice where practical. If this were not possible for the Parenting Skills Coach to do, the client would be offered an additional, free session.

Between Sessions

43. The Parenting Skills Coach may assign the client tasks or exercises to complete between coaching sessions. There is no obligation on the client to complete these “home activities”, but not doing so will probably slow the client’s progress in achieving their objectives or desired outcomes.

44. Where possible, clients are requested to submit any information requested by the Parenting Skills Coach relating to “home activities” at least 24 hours before the coaching session when they are due to be discussed. The Parenting Skills Coach will then provide feedback on completed “Home activities” during the following coaching session(s).

45. The client may contact the Parenting Skills Coach by phone or e-mail between sessions to seek clarification regarding anything arising from a coaching session or for administrative purposes (e.g. where a client needs to rearrange a coaching session or make a payment). Additional coaching can also be provided between sessions but there will be an additional charge for this. The Parenting Skills Coach will always advise a client in advance if the nature of a client’s contact is likely to incur an additional charge and no such charges will be imposed without the client’s agreement.

Reimbursement and early termination of coaching agreements

46. Should a client be dissatisfied with a coaching session, they can ask for a full reimbursement for that particular session and this would be given, provided that the request for a reimbursement had been made to the Parenting Skills Coach within 48 hours of the completion of the relevant coaching session. In any such cases, the client would be required to provide written reasons for the dissatisfaction. If a client obtains a reimbursement for a coaching session in this way, then the client and the Parenting Skills Coach would each have the option to terminate the coaching agreement immediately, confirming such termination by email or letter. If either party did terminate a coaching agreement in this way, the Parenting Skills Coach would have no obligation to provide any further coaching sessions to the client and the client would, in turn, be entitled to a reimbursement of the price of any future coaching sessions for which they had already paid, but which would no longer be provided.

47. In exceptional circumstances, such as illness or unavailability due to bereavement or other commitments, inappropriate behaviour by the client, actual or potential conflict of interest, or other reasons of force majeure, the Parenting Skills Coach can decide to terminate the service to the client early, or refuse or be unable to provide further coaching sessions to the client. In such unlikely circumstances, the client would be given maximum notice of termination by the Parenting Skills Coach and would be reimbursed any advance payments made for coaching sessions not yet provided.

48. Similarly, the client is entitled to terminate the service early at any time by giving written notice by email or letter, whether or not they are using the session reimbursement clause above. Such notice would take immediate effect as soon as it is received by the Parenting Skills Coach. In such a circumstance, the client would be entitled to a full refund for any coaching sessions already paid for but not yet provided.
